Refund Policy

1. Project Deposits. A non-refundable deposit of 30% of the total project fee is required before work commences. This deposit secures your position in our production queue and covers initial planning, scoping, and architecture work.

2. Milestone-Based Billing. Projects exceeding 1,500€ are billed in milestones tied to deliverable phases (e.g., design approval, development completion, final deployment). Each milestone payment is non-refundable once the corresponding deliverable has been submitted for review.

3. Cancellation. If you cancel a project before the first milestone deliverable is submitted, you will receive a refund of any payments made minus the initial 30% deposit and any costs incurred for work already completed. Cancellation requests must be submitted in writing to [email protected].

4. Completed Work. Upon final delivery and client acceptance, all payments are non-refundable. MarbleCodeNest provides a 30-day post-delivery support period for bug fixes related to the original scope at no additional charge.

5. Dispute Resolution. In the event of a dispute regarding refunds, both parties agree to attempt resolution through good-faith negotiation before pursuing any legal remedies. The applicable jurisdiction is Nürnberg, Germany.

Terms of Service

1. Acceptance. By engaging MarbleCodeNest for digital services, you agree to be bound by these Terms of Service. These terms constitute a legally binding agreement between you (the client) and MarbleCodeNest, Kaierberg 37, 91599 Dentlein am Forst, Germany.

2. Scope of Work. All services are defined in the project proposal or statement of work (SOW) agreed upon before work begins. Any work outside the agreed scope will be quoted separately and requires written approval before execution.

3. Intellectual Property. Upon full payment, all deliverables (source code, designs, copywriting) are transferred to the client. MarbleCodeNest retains the right to display completed work in its portfolio unless otherwise agreed in writing. Pre-existing frameworks, libraries, and tooling remain the property of MarbleCodeNest.

4. Confidentiality. Both parties agree to maintain the confidentiality of proprietary information shared during the engagement. This obligation survives the termination of the agreement for a period of 24 months.

5. Limitation of Liability. MarbleCodeNest's total liability under any engagement shall not exceed the total fees paid by the client for the specific project. We are not liable for indirect, incidental, or consequential damages including lost profits, data loss, or business interruption.

6. Warranty. MarbleCodeNest warrants that all deliverables will conform to the specifications defined in the SOW for a period of 30 days following final delivery. Warranties do not cover issues arising from third-party services, client modifications, or force majeure events.

7. Termination. Either party may terminate the agreement with 14 days' written notice. Upon termination, the client is responsible for payment of all work completed up to the termination date. MarbleCodeNest will deliver all completed work products upon receipt of final payment.

8. Governing Law. These Terms of Service are governed by the laws of the Federal Republic of Germany. The place of jurisdiction is Nürnberg, Germany.
